What is litigation funding?
Litigation financing is the financing of all costs of a legal dispute for the plaintiff. We pay all the costs of a court case and receive a share of the success in return. If you win, we receive a share of 20 - 50%. If you lose, we receive nothing and it costs you nothing.

How much does litigation funding cost?
For litigation funding, contingency payments of 20 - 50% of the litigation proceeds are common, depending on the type, scope, status and risk profile of the case. If you win the case, the litigation financier receives 20 - 50% of the amount you receive. If you lose the case, it costs you nothing. You don't have to pay anything upfront, the entire claim assessment and settlement is free of charge.

Is litigation funding available for private individuals or for companies?
Companies of any legal form and country as well as private individuals can make use of litigation financing. Please feel free to send us a Non-binding request.

How does litigation funding work?
Describe your case to us - the best way to do this is to send us a free, non-binding enquiry. This is strictly confidential and we will review your case free of charge. We will get back to you and may ask for further documentation or we may have follow-up questions. If we decide to finance your case, we will send you an offer and a litigation finance contract. As soon as this is signed, we pay Legal Finance all the costs of the proceedings.

What costs does the litigation financier pay?
You do not have to pay anything.The litigation funder pays all costs, for example:

  • Court costs
  • Legal fees
  • Fees of a correspondence lawyer
  • Expert and expert witness fees
  • Travel expenses
  • Witness expenses
  • Deposits and advances

In short: The litigation funder pays everything, you as the claimant pay nothing.

What do I get as a plaintiff from litigation funding?
With litigation funding, you can litigate the case as a plaintiff completely relaxed and without worrying about rising costs.Because as a plaintiff, the defendant already owes you money, and you are in the unpleasant situation of now having to spend money to litigate the case as well. The litigation financier takes over these costs and you do not have to pay anything up front.

As a company, you have the advantage that you do not have to make provisions for litigation costs.

In general, the advantage of litigation financing is that your liquidity is not affected because you do not have to bear any costs in advance.

What happens if the case is lost?
If the case is lost in one instance, i.e. you are defeated, you pay nothing. If a further instance, for example an appeal or revision, is possible, we will check together with you and your lawyer whether an appeal makes sense.Of course, Legal Finance will also finance the costs of a further instance. In any case, you pay nothing at all if the case is lost. In this case, the litigation financier Legal Finance assumes all costs.

Do you also finance the defendant?
In court proceedings, Legal Finance only finances the claimant, i.e. the holder of the claim. We do not currently offer financing for the defendant. Please subscribe to our newsletter and we will inform you as soon as we offer such a product.

Is a settlement possible?
Of course, we also have a positive attitude towards settlement, because settlements end legal disputes amicably and more quickly and can represent a win-win situation. Legal Finance does not interfere in the proceedings and a settlement is possible at any time.
